Privacy Policy
Your privacy is very important to us. This Policy describes how we collect and use information from you, the beta testers of PicScout’s Image Exchange™ product (the “Product”) and our efforts to protect your privacy.
The Product is a beta version of a software application that operates within web image browsing environments and is intended to provide its users with certain information regarding the viewed images (such as information regarding the identity of the owner or licensor of such images) as well as a link driving the user directly to the image landing page.
Collecting of Information
The Product will be used by you, the beta testers, for its use, review and evaluation. To facilitate this, PicScout will request certain registration information from you and will collect other data solely in the manner and for the uses explicitly set out in this policy. While this allows us to evaluate and improve our Product in order to offer our users the best service possible, we understand the high importance of personal privacy and want you to understand how we handle your personal information. This document outlines the types of information PicScout collects from you and how we store and use this data.
When and What Information We Collect
Registration Information: When you request to be a beta tester, PicScout shall ask you to provide it basic registration information such as your name, company name and email address, and you will be asked to let us know if you are a stock agent or a photographer (although in order to register as a beta tester, you will only be obligated to provide us with your name and email address). PicScout will not make any use whatsoever of this Personally Identifiable Information (as defined below) other than to correspond with you, as a beta tester, regarding your evaluation of the Product. PicScout will not correlate any Personally Identifiable Information collected during registration with the non-Personally Identifiable Information subsequently obtained by PicScout during your use of the Product.
Anonymous Data: Any time you use the Product to request the metadata associated with a certain image, such image is uploaded to a PicScout database by sending a search query to PicScout, and the Product sends standard, limited information including your machine's Internet Protocol address. This non-personally identifiable data is retained in PicScout’s server logs and protected according to this privacy policy. When you use the Product, we may also collect non-personally identifiable technical and navigational information such as computer browser type, queries, and frequency and time spent using the Product and its components. Further, the links that appear in the Product may be in a format that enables us to keep track of whether these links have been followed. Such information helps us to improve the Product and its efficiency, while other information is essential to the functioning of the Product.
How We Use the Information We Collect
PicScout only uses usage data in aggregate form, that is, as a statistical measure to improve our Product, and not in a manner intended to identify you personally. We may share aggregated non-personally identifiable information with third parties for marketing purposes.
We may provide Personally Identifiable Information and non-personally-identifiable information to our affiliated companies for the purpose of processing such information on our behalf. We require that these parties agree to process such information in compliance with our Privacy Policy, and we use reasonable efforts to limit their use of such information and to use other appropriate confidentiality and security measures.
We may disclose your Personally Identifiable Information if we have a good faith belief that disclosure of such information is helpful or reasonably necessary to i) comply with any applicable law, regulation, legal process or governmental request, ii) enforce our end user license agreement for the Product including investigations of potential violations thereof, iii) detect, prevent, or otherwise address fraud, security or technical issues, or iv) protect against harm to the rights, property or safety of PicScout, its users, yourself or the public.
Information Security
We maintain physical, electronic and procedural safeguards to protect your information and, while no data transmission over the Internet is 100% secure from intrusion, we use commercially reasonable efforts to ensure the protection of your information. We shall store your Personally Identifiable Information only for so long as it is necessary to provide you with the services offered by the Product.
Third Party Sites
We are not responsible for the practices employed by websites linked to or from the Product nor the information or content contained therein. Please remember that when you use a link to go from the Product to another website, our privacy policy is no longer in effect. Your browsing and interaction on any other website, including those that have a link on the Product, is subject to that website’s own rules and policies. Please read over those rules and policies before proceeding.
Children's Privacy
The use of the Product is not structured to attract children under the age of 13. Accordingly, we do not intend to collect Personally Identifiable Information from anyone we know to be under 13 years of age.
In the Event of Merger, Sale, or Bankruptcy
In the event that PicScout is acquired by or merged with a third party entity, we reserve the right, in any of these circumstances, to transfer or assign the Personally Identifiable Information we have collected from our users as part of such merger, acquisition, sale, or other change of control. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, we may not be able to control how your Personally Identifiable Information is treated, transferred, or used.
Your ConsentBy using the Product, you consent to the terms of our Privacy Policy and to PicScout's processing of Personally Identifiable Information for the purposes given above. If you do not agree to this Privacy Policy, please do not use the Product.
Policy Changes
This effective date of this Privacy Policy is October 12, 2009.
PicScout reserves the right to update and modify, from time to time, this Privacy Policy. You can find the most recent version of this policy at http://imagex.picscout.com/privacy. PicScout may change this policy, effective ten days after posting a new version without notice to you. Installation or any use of the Product after such change constitutes acceptance of such changes, and the changes will apply to causes of action arising after the effective date of the change. Without derogating from the aforesaid, PicScout shall make reasonable efforts to inform you that an amendment to the policy has been made, by means of a clearly stated message within the software application that shall appear during your first use of the Product following any such amendment. At the time of any changes to this policy, you will have the opportunity to discontinue using the Product.
Definitions
As used herein the following terms shall have the definitions assigned to them below:
“PicScout” means PicScout (Israel) Ltd. and any affiliates thereof.
“Personally Identifiable Information” refers to any information that identifies or can be used to identify, contact, or locate the person to whom such information pertains. This includes information that is used in a way that is personally identifiable, including linking it with identifiable information from other sources, or from which other personally identifiable information can easily be derived, including, but not limited to, name, address, phone number, fax number and email address. Personally Identifiable Information does not include information that is collected anonymously (i.e., without identification of the individual user).
